By accessing, downloading or participating in any programme, resource or service provided by Thea Hudson, you agree to these Terms and Conditions.
All resources, programmes and educational content provided by Thea Hudson are intended for general educational and informational purposes only and are not intended to replace medical advice, diagnosis or treatment.
You should consult with a qualified healthcare professional before beginning any exercise programme, particularly if you are:
Pregnant
Postpartum
Recovering from injury or surgery
Experiencing pelvic floor symptoms
Managing a medical condition
Participation in exercise is undertaken at your own risk.
By participating in any programme or using any resource provided by Thea Hudson, you confirm that:
You are medically fit to participate in physical activity; or
You have obtained appropriate medical clearance from a healthcare professional where required.
You agree to stop exercising immediately and seek medical advice if you experience symptoms including pain, dizziness, bleeding, or other concerning symptoms.
You acknowledge that participation in exercise carries inherent risks including but not limited to:
Musculoskeletal injury
Pelvic floor dysfunction
Falls or loss of balance
Muscle soreness or strain
Aggravation of existing conditions
While all resources and programmes are created with safety in mind, Thea Hudson cannot eliminate all risks associated with physical activity.
By choosing to participate in any programme or follow any advice provided, you voluntarily assume these risks.
To the fullest extent permitted by UK law, Thea Hudson shall not be held liable for any injury, loss, damage or health complication that may arise from the use of programmes, resources, or educational content provided.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence where such exclusion is not permitted under UK law.

Results from exercise programmes will vary between individuals.
When participating in online or home-based exercise programmes you are responsible for ensuring that you have:
A safe workout environment
Suitable flooring and appropriate space
Suitable equipment where required
Thea Hudson cannot be held responsible for injuries resulting from unsafe training environments or misuse of equipment.
All resources provided by Thea Hudson, including but not limited to:
Workout programmes
PDF downloads
Educational guides
Videos
Blog content
Graphics and written material
remain the intellectual property of Thea Hudson.
These materials are provided for personal use only.
You may not:
Share, reproduce or distribute resources
Upload resources to file sharing platforms
Resell or redistribute programmes
Use materials for commercial purposes without permission
Unauthorised distribution of digital resources may result in legal action.
Payment terms for coaching services, programmes or digital resources will be clearly stated at the time of purchase.
Due to the nature of digital products and downloadable resources, refunds may not be available once access has been granted, except where required under UK consumer law.
For in-person training sessions:
A minimum of 24 hours notice is required to cancel or reschedule a session.
Sessions cancelled with less than 24 hours notice may be charged in full.
If Thea Hudson needs to cancel a session, an alternative session or refund will be offered.

The PARQ collects information that is classified as special category personal data under UK GDPR Article 9. This means it has stricter legal protections than ordinary personal data.
I collect this data only where you have given explicit consent by completing and submitting the PARQ, including the confirmation tick box that acts as your electronic signature.
You can withdraw consent at any time by emailing thea@thfitness.co.uk. Withdrawing consent means I will delete your health data, but it also means I may no longer be able to safely provide coaching services to you.
Under UK GDPR I must have a lawful basis for processing your data. The bases I rely on are:
Contract: where processing is necessary to deliver the coaching, training or programmes you have purchased
Consent: for marketing communications, for the use of non-essential cookies, and for processing of special category health data via the PARQ
Legitimate interests: for basic website analytics, security and the running of the business
Legal obligation: for keeping financial and tax records as required by HMRC
Personal data is used to:
Deliver coaching sessions, training programmes and digital resources you have purchased
Tailor your training appropriately based on your PARQ responses
Communicate with you about your programme, sessions, or services
Process payments
Send newsletters, educational content and marketing communications where you have opted in

I use the following trusted third-party tools to operate the business. Each is a "data processor" under UK GDPR, meaning they process data on my behalf under formal agreements (Data Processing Agreements) which include UK GDPR safeguards.
ActiveCampaign (US): customer relationship management, email marketing, form submissions and automation. Stores your contact information and PARQ responses.
Netlify (US): hosts the standalone PARQ form page that is embedded on this website.
Squarespace (US): hosts and serves thfitness.co.uk.
Stripe (US, UK entity): payment processing. Card details are entered directly into Stripe and are never visible to me.
Zoom (US): video consultations and online sessions.
Calendly (US): appointment scheduling.
ManyChat (US): Instagram direct message automation, where you have interacted with my Instagram account.
Everfit (US): training programme delivery for online coaching clients.
Google (US): website analytics via Google Tag Manager and Google Analytics. Aggregated, non-personal data is used to understand website performance.
Meta Platforms (US): the Meta Pixel is installed on thfitness.co.uk to measure ad performance and to enable retargeting through Facebook and Instagram. Meta Lead Forms are used where you sign up via Facebook or Instagram. Use of Meta tools requires your consent via the website cookie banner.
Personal data is never sold, rented, or shared with third parties for their own marketing purposes.
Several of the sub-processors listed above are based in the United States. Where data is transferred outside the UK, it is protected by appropriate safeguards as required by UK GDPR, including:
Standard Contractual Clauses (SCCs) approved by the UK Information Commissioner
The UK-US Data Bridge where applicable
Suppliers' own technical and organisational security measures

Essential cookies: required for the website to function. No consent needed.
Analytics cookies: Google Analytics, set via Google Tag Manager. Helps me understand how visitors use the site. Set only with your consent.
Marketing cookies: Meta Pixel. Used for ad measurement and retargeting on Facebook and Instagram. Set only with your consent.

Different types of data are kept for different lengths of time:
Client records and PARQ data: retained for 7 years after the end of our coaching relationship. This is in line with standard practice for fitness and health professionals, and aligns with the UK contract limitation period.
Financial records (invoices, payment receipts): retained for 7 years to meet HMRC requirements.
Marketing contacts: retained for as long as you remain subscribed, plus 12 months for re-engagement, then deleted.
Enquiry emails: retained for 24 months unless you become a client.
Website analytics data: retained according to the default settings of Google Analytics (typically 14 months).
You can request earlier deletion of your data at any time, except where I am legally required to retain it.
Reasonable technical and organisational measures are taken to protect personal data from loss, misuse, unauthorised access or disclosure. These include:
All data stored within reputable cloud platforms with their own enterprise-grade security
All form submissions and payment processing carried out over encrypted (HTTPS) connections
Two-factor authentication enabled on all business-critical accounts
Access to client data limited to Thea Hudson only
No method of online storage or transmission is 100 percent secure. While reasonable steps are taken to protect your data, absolute security cannot be guaranteed.
You have the following rights regarding your personal data:
Right of access: request a copy of the personal data held about you
Right to rectification: request correction of inaccurate or incomplete data
Right to erasure: request deletion of your data (the "right to be forgotten")
Right to restrict processing: ask me to limit how your data is used
Right to data portability: receive your data in a portable format
Right to object: object to processing based on legitimate interests, including for direct marketing
Right to withdraw consent: withdraw consent for any processing based on consent (such as marketing or PARQ data) at any time
